Public space legislationThe public space legislation resource has been constructed as a direct result of the feedback received from Defra’s Powers, Rights and Responsibilities consultation, and has been developed by the IDeA, in partnership with Defra, the Local Government Association, and ENCAMS. The aim of this resource is to provide a quick and easy point of reference for practitioners who want to find out what legislation is on the statute book in relation to all elements of open space management, ranging from litter and graffiti to other anti-social behaviour. It also aims to provide a ‘one-stop shop’ for good practice, which you will find listed alongside each theme. April 2006 saw the commencement of the majority of provisions in the Clean Neighbourhoods and Environment Act 2005. Virtually all provisions in the Act have now been commenced, except section 68 (transfer of responsibility for stray dogs), which is still being discussed. The provisions in Schedule 1 extending the Noise Act 1996 to licensed premises will not commence until October 2006. Defra has published a list of powers, guidance on how to use them (including specific guidance for Parish Councils) and information on training. Also commencing in April is the revised Code of Practice on Litter and Refuse. Find out more on the ENCAMS website.

A brief description of the legislation or Statutory Instrument is given. You can access more information through each legislation link, which will direct you to the specific clause within the Act. In each section, we have also listed any good practice or case studies relating to the issue. Contact details and brief descriptions of the work undertaken have been given where possible.
